1. About These Terms
1.1 These Terms of Service ("Terms") govern your access to and use of the BeneYou website located at beneyou.com.au and any associated platforms, tools, or services operated by BeneYou Pty Ltd (ABN 44 673 413 799) ("BeneYou", "we", "us", "our").
1.2 By accessing or using our website, you agree to be bound by these Terms. If you do not agree, you must not use our website.
1.3 We may update these Terms from time to time. Continued use of the website after any update constitutes acceptance of the revised Terms. The date of the most recent update is shown above.
1.4 These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria.
2. Eligibility
2.1 You must be at least 18 years of age to use this website and to claim any gift card or reward offered through it.
2.2 By using this website, you represent and warrant that you have the legal capacity to enter into a binding agreement under Australian law.
3. Use of the Website
3.1 You may use this website only for lawful purposes and in accordance with these Terms.
3.2 You must not:
- (a) use the website in any way that violates applicable Australian federal, state, or local laws or regulations;
- (b) attempt to gain unauthorised access to any part of the website or its related systems;
- (c) use automated tools, bots, scrapers, or similar technology to access or interact with the website without our prior written consent;
- (d) submit false, misleading or fraudulent information in connection with a Comparison, registration, switch to a Participating Provider, verification process or Gift Card claim; or
- (e) create multiple accounts or household registrations to circumvent the one-per-household limit on Gift Card eligibility.
3.3 We reserve the right to suspend or terminate your access to the website if we reasonably believe you have breached these Terms.
4. Comparisons
4.1 BeneYou provides a comparison tool that allows users to compare products, services, or offers from participating retailers and providers ("Comparison").
4.2 Comparisons are provided for general informational purposes only. We do not guarantee the accuracy, completeness, or currency of any information displayed through the comparison tool.
4.3 BeneYou does not endorse any particular product, service or provider featured in a Comparison. Any decision to apply for, acquire or switch to a product or service is made at your own risk.
4.4 Completing a Comparison does not itself make you eligible for a Gift Card. Gift Card eligibility arises only where you complete an Eligible Switch in accordance with clause 5 and the applicable Promotion Terms.
4.5 Participating retailers and providers may change, withdraw or vary their offers at any time. BeneYou is not responsible for any discrepancy between information displayed on our website and information provided directly by a retailer or provider.
5. Gift Card Rewards
5.1 Eligibility to Claim
- (a) A gift card reward ("Gift Card") may be made available to an eligible user who completes an Eligible Switch during the applicable promotion period and in accordance with the relevant promotion terms ("Promotion Terms").
- (b) For the purposes of these Terms, an "Eligible Switch" means a switch by a user to an eligible product or service offered by a participating retailer or provider ("Participating Provider") that:
- (i) is initiated through, or is otherwise validly tracked by, the BeneYou website or the process specified in the applicable Promotion Terms;
- (ii) is completed during the applicable promotion period;
- (iii) is accepted, activated and verified by the relevant Participating Provider;
- (iv) has not been cancelled, reversed, withdrawn, rejected, refunded, subject to a chargeback, or found to be fraudulent or ineligible; and
- (v) satisfies any further eligibility requirements stated in the applicable Promotion Terms.
- (c) To be eligible to claim a Gift Card, you must:
- (i) have completed an Eligible Switch;
- (ii) be a registered user of the BeneYou platform with a verified account;
- (iii) be 18 years of age or older; and
- (iv) not have claimed a Gift Card from the same promotion from the same household within the current promotion period.
- (d) Only one Gift Card claim is permitted per household per Eligible Switch. For the purposes of these Terms, "household" means individuals residing at the same residential address.
- (e) Gift Cards are not transferable and may not be exchanged for cash.
5.2 Verification and Issue
- (a) BeneYou may require a period of time to verify an Eligible Switch with the relevant Participating Provider before making a Gift Card available.
- (b) The applicable Promotion Terms may state an estimated or maximum verification period. Any stated timeframe is an estimate unless expressly stated otherwise.
- (c) A Gift Card will only be made available after BeneYou receives confirmation, or otherwise reasonably determines, that the relevant switch is an Eligible Switch.
- (d) BeneYou is not responsible for a delay in verification or issue caused by a Participating Provider, incomplete information supplied by you, technical issues, fraud checks, cancellation or reversal of a switch, or circumstances outside BeneYou's reasonable control.
5.3 Fraudulent or Ineligible Switches and Claims
- (a) BeneYou may refuse, cancel or void a Gift Card claim if it reasonably believes that:
- (i) the claim or relevant switch was fraudulent, manipulated, false, misleading, incomplete or made in breach of these Terms or the applicable Promotion Terms;
- (ii) the relevant switch was cancelled, reversed, withdrawn, rejected, refunded, subject to a chargeback or otherwise did not become an Eligible Switch; or
- (iii) the user has attempted to circumvent the one-per-household, one-per-promotion or other eligibility requirements.
- (b) If a Gift Card has already been issued in relation to an ineligible switch or claim, BeneYou may cancel the Gift Card to the extent permitted by law, recover its value from you, and suspend or terminate your account.
5.4 Claim Window and Expiry
- (a) Once a Gift Card is made available to an eligible user, it must be claimed within 30 days of the date of notification ("Claim Window").
- (b) Notification will be sent to the email address registered to your BeneYou account.
- (c) Gift Cards that are not claimed within the Claim Window will lapse automatically and will no longer be available to claim, reissue, redeem or exchange.
- (d) BeneYou is not required to extend the Claim Window or reissue a Gift Card that has lapsed. A user whose Gift Card has lapsed may become eligible for a new Gift Card only by completing a new Eligible Switch in connection with a future qualifying promotion, subject to these Terms and the applicable Promotion Terms.
- (e) Once claimed, a Gift Card may be subject to its own expiry date, redemption conditions and other terms set by the Issuer. BeneYou is not responsible for an expiry date or redemption condition imposed by a third-party Issuer after the Gift Card has been claimed.
6. Intellectual Property
6.1 All content on this website, including text, graphics, logos, images, and software, is owned by or licensed to BeneYou and is protected by Australian copyright and intellectual property laws.
6.2 You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent.
6.3 The BeneYou name, logo, and any associated trade marks are the property of BeneYou Pty Ltd. Nothing in these Terms grants you any right to use our trade marks.
7. Privacy
7.1 We collect, use, and disclose personal information in accordance with our Privacy Policy.
7.2 By using this website and participating in any promotion, you consent to the collection and use of your personal information as described in our Privacy Policy.
7.3 We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
8. Disclaimer and Limitation of Liability
8.1 To the maximum extent permitted by law, BeneYou provides this website and all content on an "as is" basis without any warranty, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.2 BeneYou does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.
8.3 To the maximum extent permitted by law, BeneYou excludes all liability for any loss or damage (including indirect, consequential, or special loss) arising from your use of the website, any Comparison, or any Gift Card, whether in contract, tort, or otherwise.
8.4 Where liability cannot be excluded under the Australian Consumer Law or other applicable legislation, our liability is limited to the maximum extent permitted, including (where applicable) resupplying the relevant service.
9. Third-Party Links and Services
9.1 This website may contain links to third-party websites or services. Those links are provided for convenience only. BeneYou does not endorse and is not responsible for the content, privacy practices, or terms of any third-party website.
9.2 Your use of any third-party website or service is at your own risk and subject to that third party's terms and conditions.
10. Termination
10.1 We may suspend or terminate your access to the website at any time, with or without notice, if you breach these Terms or if we reasonably consider it necessary to protect the integrity of the platform.
10.2 Termination does not affect any rights or obligations that arose before termination, including any outstanding Gift Card claims made prior to termination.
11. General
11.1 If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force.
11.2 Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
11.3 These Terms constitute the entire agreement between you and BeneYou in relation to your use of the website and supersede all prior agreements or representations.
